Hello,
I seek clarification in regards to consequential Loss for Existing Structures. Under SCC 2007, Schedule B1, Rules 6.1/6.2 the Principal's insurance for existing structures can include consequential loss. What happens on a Alteration to an Existing structure (i.e. Workshop fitout) if the contractor does not finish the Contract Works in time and the client is not able to occupy the facility in time? If no liquidated damages had been defined under the Contract, could the client retrieve the loss incured (i.e. having to teach students already enrolled somewhere else till Practical Completion can be issued to be able to occupy the workshop) via the consequential loss cover? Would in such a case the Principals insurance try to recover the cost from the Contractor or would the whole thing need to be settled under the contractual dispute resolution options (mediation, arbitration)?
